Two things I can think of (probably both wrong, but keep 'em in mind anyway)...
If power to the TPS has been disconnected with the battery still CONNECTED, the computer changes the default shift cycle in the tranny to default mode, until after several drive/shift cycles. No harm will be done if this is the case.
Scenario two might indicate a problem - electrical, or mechanical, or both. The fluid pressure and/or TC lockup modes have changed. At 44k, I'm guessin' there's an electrical problem. The computer might or might not be able to tell ya where the problem is. To confirm an electrical problem: Next time you get the hard shift, pull over, disconnect the battery for a few minutes, reconnect and go. If you get a few good shift cycles, you probably have a short circuit somewhere, with no mechanical problems.
If 'two' is the case - an electrical problem, continued tranny operation in this mode WILL lead to mechanical problems...

How does your fluid look? For all you know the prior owner maybe added something to the fluid and it takes heating up for it to thin. Just a suggestion.
